1. Introduction and agreement

These Terms of Service ("Terms") govern your access to and use of the Aidovia website and waitlist (collectively, the "Service").

Aidovia, Pflaumstraße 14, 76669 Bad Schönborn, Germany. Legal contact: legal@aidovia.com. For privacy and data protection matters, please contact privacy@aidovia.com.

By accessing or using the Service, including by visiting the website or joining the waitlist, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Eligibility

The Service is intended for individuals who are at least 16 years old. By using the Service, you represent that you meet this requirement. If you access the Service on behalf of a company, organisation or other entity, you confirm that you are authorised to bind that entity to these Terms.

3. Use of the Service (acceptable use)

You agree to use the Service only in a lawful manner and in accordance with these Terms. In particular, you agree that you will not:

  • provide false, misleading or unauthorised information;
  • use the Service in a way that violates any applicable law or regulation;
  • attempt to gain unauthorised access to any systems, accounts or data;
  • interfere with or disrupt the security, integrity or performance of the Service;
  • use automated tools (such as bots, scrapers or crawlers) to access the Service, except where expressly permitted by us in writing;
  • infringe the rights of Aidovia or any third party, including intellectual property and privacy rights.

We may suspend or restrict access to the Service if we reasonably believe that you are violating these Terms or applicable law.

4. Waitlist and communications

To join the Aidovia waitlist, you must provide a valid email address. By joining the waitlist, you agree that:

  • we may send you transactional messages related to your signup and important updates about Aidovia;
  • we may send you marketing or newsletter-style emails about Aidovia, the platform and related launches, based on your consent.

You can unsubscribe from marketing emails at any time by using the unsubscribe link in our emails or by contacting us. For information on how we process personal data, please refer to our Privacy Policy.

5. Intellectual property

All content on the Service, including the Aidovia name, logo, branding, text, graphics, design and layout, is owned by Aidovia or its licensors and is protected by copyright, trademark and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use. You may not copy, reproduce, redistribute, modify, create derivative works from, or publicly display any part of the Service unless expressly permitted by us or required by applicable law.

You may not use the Aidovia name, logo or branding without our prior written permission.

6. Third-party services and links

The Service may include links to third-party websites or services, such as crowdfunding platforms or social networks. These are provided solely for convenience.

Aidovia does not control and is not responsible for third-party websites or services, and your use of them is at your own risk and subject to their own terms and privacy policies.

7. Disclaimer

The Service is provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied, to the fullest extent permitted by law.

In particular, we do not warrant that the Service will be uninterrupted, secure or error-free, or that any content will always be accurate, complete or up to date.

Nothing in these Terms affects any warranties or rights that cannot be excluded or limited under mandatory consumer protection laws, especially for users in the EU/EEA (including Germany) and the UK.

8. Limitation of liability

To the maximum extent permitted by applicable law, Aidovia and its founders, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of data or loss of goodwill, arising out of or in connection with your use of the Service.

To the extent that we are liable for any direct damages and such liability cannot be excluded, our aggregate liability in connection with the Service shall be limited to the amount you have paid us (if any) in the twelve (12) months preceding the event giving rise to the claim. As the current Service is a free landing page and waitlist, this amount will typically be zero.

The above limitations do not apply where such liability cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, intentional misconduct or gross negligence, fraudulent misrepresentation, or any other liability that cannot be limited under mandatory law (including under German, EU or UK consumer law).

9. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or the Service are governed by the laws of Germany, without regard to conflict-of-law rules.

For users in the EU/EEA (including Germany) and the UK, if you are a consumer, you also benefit from any mandatory consumer protection provisions of the law of your country of residence. Any disputes may be brought before the competent courts in Germany. As a consumer, you may also have the right to bring claims in the courts of your habitual residence.

For users in the United States or other countries, you agree that any disputes will be subject to the laws of Germany as set out above and to the non-exclusive jurisdiction of the courts in Germany, without prejudice to any mandatory rights you may have under local law.

10. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the Service or in applicable law. The "Last updated" date at the top of this page indicates the current version.

Where changes are significant, we may also notify you through the Service or by email. By continuing to use the Service after the updated Terms take effect, you agree to the updated Terms.
